TERMS AND CONDITIONS

Welcome to RiceMi.nz.  These following terms of use are intended to explain our obligations as a product provider and your obligations as a customer.  You agree to be bound by, and comply with, these terms and conditions.  Please read them carefully.

COMPANY INFORMATION - RiceMi Ltd is a registered New Zealand Company.  Contact is via email - info@ricemi.nz

Prices are paid via direct deposit or cash.  Promotions are based on the unit only, excludes delivery and/or packaging

RiceMi Ltd endeavour to ensure that advertised items are available for the website or until sold out.  Some products advertised may not be displayed and are subject to availability.  If goods are unavailable due to circumstances beyond our control, we do not accept responsibility.  All sizes quoted in this website are quoted as approximate only.  Any discounts will be off the retail price.  We reserve the right to correct any website print errors or misprints.

You may order products from this website in accordance with these terms and conditions.  An order placed through this Site is an offer by you to purchase the Product for the listed price (excluding freight and any other charges) at the time the order is placed.  You agree to provide us with your up-to-date, accurate, non-fraudulent and complete details when submitting an order.  Courier sales must have a house/company address not a PO BOX number.  Pick up is via appointment only in Auckland.

Each order placed for products through the site that is accepted, results in a separate binding agreement between you and us for the supply of those products.  For each order accepted by us, we will supply the products to you in accordance with these terms and conditions and provide you with an email confirmation of the order.  If your order is rejected, then we endeavour to notify you at the time you place the order or within a reasonable time once the order is submitted.  The purchase price of each product is shown on the product list on the site at the time you place your order.  Subject to typos/mis-prints, and delivery address being in correct, once ordered the price of our product will not change.

Please note orders are completed and sent out on Wednesdays unless stated otherwise.  We will charge you, and you agree to pay, the purchase price of each product that is ordered, the delivery/courier charges will be added and, in some cases, calculated after you have ordered your product.  This is to allow for cases of multiple products on one order.  

If we do not have a particular product ordered in stock, then we will use a reasonable time frame of 30 days to order the relevant product.  We will notify you of any anticipated delivery delays.

All fees and charges, products include GST where applicable.  You may pay the fees and charges for an accepted order using Direct Debit and by negotiation and appointment via cash.

If we are unable to successfully process your payment then we may cancel your order.  You must not pay, or attempt to pay for products through any fraudulent or unlawful means.

You agree that the RiceMi Ltd shall retain the title in the supplied goods until payment is received in full.

Romalpa Clauses:

You agree that in the event of non-payment on insolvency the customer an/or its agents shall permit the supplier and/or its agents to enter without any hindrance, the premises to repossess the supplied goods.

You agree that proceeds of any sale of the supplied goods to a third party (customers client(s)) shall be the property of the supplier and such funds shall be kept (in Trust) in a separate bank account naming the Supplier as the beneficial owner and such funds shall be used towards full payment of the supplied goods in the event of non-payment or insolvency by the customer

You agree in the even of non-compliance with these above Romalpa Clauses, the Executives of the Company shall also become personally liable for full payment of the goods supplied by the supplier.

All warranties are limited to New Zealand.

CANCELLING ORDERS/PRODUCT RETURNS/ERRORS

We may cancel any part of an order, at any time without any liability for that cancellation if the products in that are ordered are not available; or if there is an error in the price or the product description posted on the Site for the product; or that we reasonably believe your order has been placed in breach of these terms and conditions.  If we cancel your order we will endeavour to provide you with reasonable notice of that cancellation, we will not charge you for the cancelled order.  Rice Mi Ltd are under no obligation to complete a sale if pricing or other production information is displayed incorrectly and/or in error.

You must check any product delivered to you to determine if it is damaged.  If a product is damaged on delivery, then you should refuse to take receipt of that product and notify us through email.  If you notice damage to a product after delivery, you should notify us within 7 days of delivery.  If so, you may return the product to us in accordance with this clause.

If you purchase online and want to return the product your purchase, please note that under the Consumer Guarantees Act, there is no legal requirement for Rice Mi Ltd to accept returned goods if you have merely changed your mind.  Please choose carefully.  Rice Mi Ltd may accept certain goods back if they are returned unopened, unused and in original undamaged condition within a period of 7 days only.  Noting that there is a restocking fee of 20-35% depending on the company of return.  You are entitled to guarantees and rights to return faulty goods that may be given by the manufacturer of the goods and by law except where excluded in these terms and conditions.

If your product has been shipped, we do not accept returns unless the item is damaged or faulty.  If this is the case, the product will be either repaired or replaced under the manufacturer’s warranty.

Refunds will only be refunded to the purchaser of the product, with photo ID and proof of purchase.  Refunds via internet, subject to stores discretion, and proof of purchase.

Exclusions to the Fair Trading Act 1986 and Consumer Guarantees Act 1993

Where you are in trade, you agree it is fair and reasonable that the following provisions of the Fair Trading Act are excluded:

- Section 9 which prohibits misleading and deceptive conduction general;

- Section 12A which prohibits unsubstantiated representations; and

- Section 13 which prohibits false or misleading representations.

The guarantees under the Consumer Guarantees Act 1993 are excluded for all purchases of goods made for business purposes.  However any manufacture's warranty and the Sale of Goods Act 1908 will continue to apply.

All prices are in New Zealand dollars (NZ$) and include GST (15% sales tax).

Order confirmation and invoices are automatically delivered via email.

All brand names are to their respected owners and distributors.  All pricing are subject to change without due notice and errors and omissions apply.

PRODUCT PICK UP/COURIER

Products can be picked up by appointment in Auckland only.   You may obtain further information on this Site regarding our courier time frames and how we deliver certain Products. The Courier Fee for your order depends on the type of Product you order (in particular, the size and weight of the Product(s) and also your location. Rural deliveries will incur an extra surcharge.

You agree to comply with certain delivery requirements specified in these terms and conditions and any other requirements that we notify you of when you place your order through the Site. We suggest that you be present to accept the delivery of your order.  We may require the person accepting the delivery of your order to provide us with proof of that person's identity (including photographic identification) and, where relevant, age.

If there is no one over 18 years of age who is available at the Delivery Address to receive the order or then we will not deliver the Products you have ordered. In this instance, we will endeavour to contact you or you may contact us to arrange for delivery at a different time, and we may charge you an additional delivery fee for that replacement delivery.

Risk and title to the Products passes to you on the date and time of delivery to the specified delivery address.

Order Confirmation: If you order Services or products  directly from us, we may share the Personally Identifiable Information you provide on our confirmation page with a select group of third party marketing partners that offer similar products/services you may be interested in. We only work with marketing partners that contractually agree to offer you the ability to opt-out of receiving future offers, and contractually agree not to share your  information with others. Responses to Email Inquiries: When Visitors send email inquiries to us, the return email address is used to answer the email inquiry we receive. We do not use the return email address for any other purpose and do not  share the return email address with any third party. We may retain these emails for our records, only for use as a reference.
